Dinamika Pengaturan Norma Politik Uang dalam Pemilihan Kepala Daerah: Analisis Yuridis dalam Perspektif Tujuan Hukum

Abstract


People’s sovereignty as mandated by the 1945 Constitution of the Republic of Indonesia is implemented through general elections, including regional head elections (pilkada), based on the principles of direct, general, free, secret, honest, and fair (Luber Jurdil). The principles of honesty and fairness are often threatened by the practice of money politics, which disrupts the integrity of the democratic process. This study aims to analyze the dynamics of the regulation of money politics norms in regional head elections from Law Number 32 of 2004 to Law Number 10 of 2016 and to assess their conformity with the purpose of law based on ethical and utilitarian legal theories. The research employs a normative juridical method with statutory and conceptual approaches. Primary legal materials consist of regional head election laws and their amendments, while secondary legal materials include relevant literature and journals. The results show that the regulation of money politics norms has developed progressively in terms of the scope of subjects, stages, and formulations of offenses; however, substantial weaknesses remain, particularly the equal sanctions imposed on both the giver and the receiver. From the perspectives of justice and utility, an ideal composition of norms has not yet been achieved, thereby hindering the substantive realization of honest and fair regional head elections.
